Terms of service

Welcome to Yard.tt. These Terms of Service (“Terms”) govern your access to and use of the Yard.tt website, platform, and related services (collectively, the “Service”) operated by Yard.tt (“we,” “us,” or “our”), a real estate brokerage registered in the Republic of Trinidad and Tobago.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

You must be at least 18 years of age and legally capable of entering into binding contracts under the laws of Trinidad and Tobago to use our Service. By creating an account, you represent and warrant that you meet these eligibility requirements.

3.1 Account Creation

Certain features of our Service require you to create an account. Account authentication is managed through our provider, Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Types

Our Service supports the following account types:

• Registered Users — May save favourite listings, set up property alerts, submit inquiries, and manage account preferences.
• Agents — Licensed real estate professionals who have been approved by Yard.tt. Agents may create and manage property listings, respond to inquiries, and access the agent portal.
• Administrators — Authorised Yard.tt staff with elevated platform management privileges.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason we deem necessary to protect the integrity of our Service.

4.1 Accuracy of Listings

Property listings on our platform are provided by licensed agents and third-party sources. While we make reasonable efforts to ensure the accuracy of listing information — including property descriptions, pricing, photographs, and availability — we do not guarantee that such information is complete, accurate, or current.

All property prices are displayed in Trinidad and Tobago Dollars (TTD) unless otherwise indicated. Prices and availability are subject to change without notice.

4.2 No Guarantee of Transaction

Our Service facilitates the connection between prospective buyers or renters and property agents. We do not guarantee that any property transaction will be completed. Yard.tt is not a party to any purchase, sale, or rental agreement entered into between users and agents unless explicitly stated in a separate written agreement.

4.3 Agent Responsibilities

Agents who list properties on our platform are responsible for ensuring that all listing information is accurate, truthful, and compliant with applicable laws and regulations of Trinidad and Tobago, including the Real Estate Agents Act. Agents must have proper authorisation to list any property.

You agree not to use our Service to:

• Provide false, misleading, or fraudulent information in listings, inquiries, or account profiles
• Impersonate any person or entity, or falsely represent your affiliation with a person or entity
• Scrape, crawl, or use automated means to access or extract data from our platform without our written consent
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
• Transmit viruses, malware, or any other malicious code
• Use the Service for any illegal purpose or in violation of any applicable laws of Trinidad and Tobago
• Harass, abuse, or harm other users, agents, or Yard.tt staff
• Post or transmit spam, unsolicited advertising, or promotional materials through our inquiry or contact systems

6.1 Our Content

The Service and its original content (excluding content provided by users and agents), features, and functionality are and will remain the exclusive property of Yard.tt. This includes our trademarks, logos, trade names, website design, text, graphics, and software.

6.2 User Content

By uploading content to our Service (including property images, descriptions, and other materials), you grant Yard.tt a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content in connection with the operation of the Service. You represent that you own or have the necessary rights to grant this licence for any content you upload.

When you submit an inquiry or contact form through our Service, your message and contact details will be shared with the relevant agent or Yard.tt staff member. We may also send you email notifications related to your inquiry, account activity, or property alerts via our email delivery service.

We maintain records of communications facilitated through our platform. By using our inquiry and messaging features, you consent to such record-keeping.

Our Service allows authorised users to upload files, including property images and documents. Uploaded files are stored using cloud storage services. You are solely responsible for ensuring that any files you upload:

• Do not infringe upon any third party’s intellectual property rights
• Do not contain malicious code or harmful content
• Comply with all applicable laws and regulations
• Are appropriate for a professional real estate platform

We reserve the right to remove any uploaded content that violates these Terms or that we deem inappropriate at our sole discretion.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) property listing information is complete or accurate; (c) any particular property will be available or suitable for your needs; or (d) the results obtained from the use of the Service will be accurate or reliable.

Yard.tt does not provide legal, financial, or tax advice. You should consult with qualified professionals before making any real estate transaction decisions.

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF TRINIDAD AND TOBAGO, MORELLI REAL ESTATE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us, if any, in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Yard.tt and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party’s rights; or (d) any content you upload or submit through the Service.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Trinidad and Tobago, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@yard.tt. We will make reasonable efforts to resolve the dispute within 30 days.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated “Last updated” date. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
